COVERS EVEN SMALL EMPLOYERS
California’s harassment protections apply to employers with one or more employees.
HARASSERS CAN BE LIABLE
Under California law, the individual who harasses can be held personally responsible.
Understanding your rights
Sexual harassment is prohibited by California law and by federal law. It generally takes two forms:
Quid pro quo
Job benefits — a raise, a promotion, a schedule, or keeping the job at all — conditioned on submitting to sexual conduct.
Hostile work environment
Unwelcome conduct of a sexual nature, or based on sex, that is severe or pervasive enough to change the conditions of work.
An employer can also be responsible for harassment by clients, customers or vendors if it knew or should have known about the conduct and did not take immediate and appropriate corrective action.
Matters we handle
